terms

Translation for convenience. In case of doubt, the German version prevails.

1. Scope

1.1 These Terms and Conditions apply to all orders placed by consumers with Vanished Gallery via the online shop at www.vanishedgallery.com.
1.2 A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contracting party

The purchase contract is concluded with:
Vanished Gallery, owner Max Danner, Tangastr. 42, 81827 Munich, Germany
Email: lost@vanishedgallery.com

3. Conclusion of contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
3.2 By clicking the "Buy now" (or "Place order and pay") button, you submit a binding offer to purchase the goods in your cart.
3.3 The contract is concluded when we accept your order by sending an order confirmation by email, which we send immediately after receiving your order.
3.4 The contract languages are German and English. We store the contract text. You will receive your order details and these Terms and Conditions with the order confirmation email.

4. Nature of the goods

Our garments are individually cut, treated and printed by hand. Holes, cuts, raw edges, print variations and slight differences between individual pieces are intended design features and part of the agreed characteristics of the goods. They do not constitute a defect. Colours and details may differ slightly from the images.

5. Prices and shipping costs

5.1 As a small business under Section 19 of the German VAT Act (Kleinunternehmerregelung), we do not charge and therefore do not show VAT.
5.2 In addition to the product prices, the following shipping costs apply per order:
- Germany: €5 – free shipping from €145
- Austria: €14 – €10 from €250
- Switzerland: €15
- Canada: €26
5.3 For deliveries to countries outside the EU (Switzerland, Canada), customs duties, import taxes and fees may apply. These are payable by the customer, not to us but to the competent customs and tax authorities or the carrier, and are usually collected upon delivery. We recommend that customers obtain details from the competent authorities before ordering.

6. Delivery

6.1 We deliver to Germany, Austria, Switzerland and Canada. We currently do not deliver to the USA.
6.2 Delivery times from conclusion of the contract (for prepayment: from receipt of payment):
- Germany: 2–4 business days
- Austria: 2–8 business days
- Switzerland: 5–8 business days
- Canada: 14–21 business days
Different delivery times, e.g. for drops or pre-orders, are stated on the respective product page.

7. Payment

You can pay via Shopify Payments (e.g. credit and debit card, Apple Pay, Google Pay) or PayPal. The available payment methods are shown at checkout.

8. Retention of title

The goods remain our property until paid in full.

9. Warranty

Statutory warranty rights apply. Section 4 (intended design features) remains unaffected.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose compliance you may regularly rely), our liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded.

11. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our Right of Withdrawal notice, which you also receive with the order confirmation. In the event of withdrawal, you bear the direct costs of returning the goods.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
